Immigration strategy before you need an immigration department.
Attorney-led immigration strategy
One employee needs an H-1B transfer. Another wants permanent residence. A candidate may qualify for O-1 status. Someone has an approved I-140 but cannot file adjustment of status for years. Recruiting wants an answer today. HR wants a policy. Finance wants to know what it will cost. And nobody is quite sure who owns the process.
Walker Legal Solutions helps growing companies make sense of it.
I work with U.S. businesses on employment-based immigration strategy, sponsorship planning, permanent residence, visa transitions, consular processing, and the systems necessary to manage immigration responsibly as the company grows.
Practical immigration counsel. Better systems. Fewer surprises.
But you probably need a strategy.
Large companies have internal immigration teams, outside counsel, mobility vendors, dashboards, sponsorship policies, and entire departments devoted to moving people across borders.
Growing companies usually do not.
Instead, immigration gets divided among founders, HR, recruiters, employees, outside lawyers, payroll, and whoever happens to know where the last petition was saved.
That works until it doesn't.
Walker Legal Solutions helps businesses build a more deliberate approach to immigration before the process becomes expensive, inconsistent, or difficult to unwind.
Immigration is rarely just about filing a form.
A company may have several possible paths for the same employee, each with different timing, cost, risk, portability, and long-term consequences.
I advise companies and foreign national employees on matters involving:
01
New petitions, changes of employer, extensions, portability, status changes, travel considerations, and planning around employment transitions.
02
PERM feasibility, Department of Labor requirements, recruitment and advertising periods, timing, filing strategy, review of prior filings, and coordination with the subsequent I-140 process.
03
Employment-based immigrant petitions, priority-date strategy, supporting evidence, category considerations, and long-term permanent residence planning.
04
Planning the progression from temporary employment authorization to permanent residence, including PERM, I-140, adjustment of status, consular processing, and the realities of Visa Bulletin backlogs.
05
Strategy for highly accomplished professionals whose credentials may support an extraordinary-ability classification.
06
Evaluation of NIW as an alternative permanent-residence pathway where traditional employer sponsorship or PERM may not be the best fit.
07
CEAC, National Visa Center and Department of State processing, document preparation, interview planning, and coordination following petition approval.
08
Changing employers, changes in job duties, travel, status expiration, prior filings, portability, delayed priority dates, and other situations where the original immigration plan no longer matches reality.
At some point, immigration stops being a collection of individual cases and becomes an operational problem.
These are not simply form-preparation questions.
They are program-design questions.
Walker Legal Solutions can help companies develop practical immigration infrastructure, including:
The goal is not to create more bureaucracy.
The goal is to make immigration predictable enough that the company can grow without reinventing the process for every hire.
Walker Legal Solutions is designed for growing and mid-sized businesses that employ or recruit foreign national talent but do not maintain a large internal immigration department.
That may include technology companies, healthcare organizations, professional services firms, engineering companies, research organizations, startups, established privately held companies, and other employers competing for specialized talent.
Whether the business is organized as a corporation, LLC, partnership, or another structure matters less than the underlying problem:
You employ people whose ability to work for you depends upon immigration law, and you need a reliable way to manage that responsibility.
The legally available option is not always the best business option.
A sponsorship strategy may affect:
Good immigration planning considers the entire employment lifecycle, not just the next filing deadline.
Chelsea E. Walker, Attorney at Law
Walker Legal Solutions is led by Chelsea E. Walker, a licensed attorney with more than 13 years of experience across federal immigration practice, government representation, prosecution, litigation, and law firm operations.
Chelsea founded and operates a federal immigration practice serving clients throughout the United States and through U.S. consular posts abroad. Her immigration work includes employment-based and family-based matters, nonimmigrant petitions, immigrant petitions, adjustment of status, consular processing, waivers, naturalization, and complex status strategy.
Her employment-based experience includes matters involving Form I-129, Form I-140, H-1B portability and employer changes, PERM strategy and Department of Labor requirements, O classifications, National Interest Waivers, Visa Bulletin planning, and consular processing through the Department of State.
Before private immigration practice, Chelsea served as an Assistant Attorney General for the State of West Virginia and as an Assistant Prosecuting Attorney, giving her experience not only advising clients but also working inside government systems, administrative processes, litigation, and regulatory decision-making.
As a law firm founder, she has also personally built the systems surrounding legal service delivery, including intake, eligibility screening, evidence collection, document review, case preparation, client communication, payment processing, technology implementation, automation, and AI-assisted workflows.
That combination gives WLS a different perspective on global mobility:
The immigration law matters. So does the system responsible for carrying it out.
Chelsea does not approach immigration solely as a sequence of government forms.
She has spent years advising people through high-stakes legal decisions while simultaneously operating the business responsible for delivering those services. That experience informs WLS's approach to employer immigration programs, where legal strategy must work alongside Recruiting, HR, Finance, payroll, outside counsel, employees, technology, and business leadership.
WLS helps companies understand not only what immigration law permits, but how to build processes that make those legal strategies workable inside an actual organization.
Counsel You Can Actually Call
Modern immigration programs generate enormous amounts of information.
Petitions. Passport records. I-94s. Labor certification documentation. Employee data. Deadlines. Emails. Government notices. Recruitment records. Visa Bulletin movement. Consular processing. Internal approvals.
The problem is rarely a lack of information.
It is that the information lives everywhere.
Walker Legal Solutions is particularly interested in helping companies use better systems, automation, and responsible AI-enabled workflows to reduce administrative work while preserving attorney judgment, confidentiality, accuracy, and appropriate human review.
Technology should reduce complexity. It should not simply give HR another dashboard to maintain.
You do not necessarily need another vendor sending status reports.
Sometimes you need someone who can look at the whole system and ask:
Those are the questions Walker Legal Solutions is built to help answer.
Moving employees across borders can create issues well beyond the visa petition itself.
Depending on the employee, assignment, destination, and corporate structure, a mobility decision may also affect:
individual tax residency, payroll withholding, compensation, equity, social security obligations, tax treaties, assignment costs, and employer reporting requirements.
WLS focuses on the immigration and legal strategy. When a matter also raises tax considerations, we can coordinate with experienced tax professionals to help the company and employee obtain a more complete picture before decisions are made.
For companies evaluating a new hire, international transfer, long-term assignment, permanent residence strategy, or international expansion, WLS can help coordinate a global mobility strategy consultation that considers both the immigration path and the tax questions that should be addressed.
The objective is simple: identify the issues early, before a visa, payroll, tax, or employment decision creates a problem somewhere else.
WLS does not provide tax or accounting advice. Tax matters are handled by independent qualified tax professionals or the client's existing tax advisors.
You do not need a multinational workforce to benefit from an immigration strategy.
A strategy session can be used to evaluate:
You will leave with a clearer understanding of the immediate immigration issues, the decisions that need to be made, and what should happen next.
Need the bigger picture?
For mobility matters involving both immigration and tax considerations, WLS can coordinate with tax professionals so the company can evaluate the immigration, payroll, residency, and tax implications together.
Usually not.
Many growing companies reach a point where immigration is too important to manage informally but does not yet justify an entire internal department. Outside counsel can help create structure while the company grows.
Yes. Sponsorship decisions can involve legal eligibility, timing, cost, company policy, immigration history, business need, and long-term strategy.
I advise on PERM strategy and requirements, including Department of Labor requirements, recruitment and advertising periods, filing timing, and the relationship between PERM, I-140 and permanent residence. The exact scope of representation is determined during engagement.
Yes. My employment-based immigration experience includes I-129 and I-140 matters as well as related status and permanent-residence strategy.
Those possibilities should be evaluated rather than automatically placing every employee into the same sponsorship pipeline. Some highly accomplished professionals may have immigration options outside a traditional PERM-based strategy.
Yes. I advise on CEAC, Department of State and consular processing when a visa or immigrant visa must be completed abroad.
Possibly, but that is not necessarily the objective.
I can also work strategically alongside existing immigration counsel, review current processes, identify gaps, assist with individual matters, or help the company determine whether its existing counsel and vendors are serving it effectively.
Federal immigration law permits immigration representation without the attorney being admitted in every state. Chelsea Walker is licensed and in good standing with the West Virginia State Bar.
Walker Legal Solutions provides U.S. immigration counsel. Matters requiring the law of another country may require coordination with qualified foreign counsel.
Tell us about the employee, the role, or the process that is not working. We will follow up to schedule the session.
